Terms of Use for D1 Arena

IMPORTANT PLATFORM NOTICE
D1 Arena provides esports tournaments, live streaming, creator monetization, and community features. Tournaments are structured around participant or team performance, but a contest's eligibility and legal treatment can depend on its game, rules, entry method, prize, participant age and location, and applicable law. D1 Arena does not represent that every event is lawful in every jurisdiction. Review the event details and these Terms before entering.
1. Acceptance of Terms
By accessing D1 Arena ("Platform"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
- Minimum age: You must be at least 13 to create an account.
- Ages 13–17: Parent/guardian verification is required under D1 policy. Youth accounts may join free tournaments but may not enter paid tournaments or receive cash tournament prizes.
- Youth creator monetization: A separate parent/guardian monetization-consent and Stripe setup path may allow an eligible youth creator to receive tip or supporter-subscription earnings. This does not unlock paid-entry tournaments or cash tournament prizes.
- Ages 18+: Paid tournaments, prizes, wallet records, and creator payouts remain subject to location, identity, tax, event, account, and provider requirements.
- Location: You may use only features legally available where you are located. You must provide accurate age and location information and may not evade eligibility controls.
3. Account Registration & Security
You must provide accurate information, maintain one account unless D1 authorizes otherwise, keep credentials confidential, and promptly report suspected compromise. You are responsible for activity performed through your account except to the extent prohibited by law.
Account Security Requirements
- Use a unique password or registered passkey and keep recovery methods current.
- Do not share passwords, passkeys, wallet PINs, recovery codes, or two-factor codes.
- Two-factor authentication may be required for financial, creator, moderator, or administrative actions.
- D1 may use email, TOTP, SMS, passkeys, device/session controls, rate limits, and risk checks to protect accounts.
External Community Services
\nD1 Arena does not provide account linking, automated notifications, role synchronization, platform voice rooms, or tournament casting through Discord. Users may independently use third-party community services outside D1 Arena; those services are governed by their own terms and privacy practices. D1-native Team HQ, Watch Parties, friend calls, and Official Cast do not require an external community account.
\n4. Identity Verification
D1 or its providers may require identity, age, parent/guardian, business, advertiser, or payout verification when necessary for a feature, transaction, safety control, or legal/provider obligation.
Stripe-Hosted Verification
- Stripe Connect and Stripe Identity may collect government ID, selfie, address, tax, bank, and related verification information through Stripe-hosted flows.
- D1 stores provider identifiers, verification status, limited verified outputs needed by the product, and audit records. D1 does not store full identity-document files or full payment-card numbers.
- Stripe retains data under its own terms and privacy policy. Successful verification does not itself mean all Stripe-held identity data is immediately deleted; supported redaction or deletion processes may be used when appropriate.
- Failure, expiration, provider review, inconsistency, or refusal to complete a required check may prevent access to the related feature or payout.
5. Tax Compliance Requirements
Tax compliance is handled automatically through Stripe Connect Express:

- SSN Collection: Stripe securely collects your SSN during onboarding - D1 Arena never sees or stores it
- W-9/W-8BEN Forms: Stripe collects and validates all required tax documentation electronically
- 1099-K Filing: Stripe automatically generates and files Form 1099-K with the IRS for qualifying payouts
- Year-End Tax Documents: Access your tax documents anytime through your Stripe Express Dashboard
IRS Reporting
- Stripe reports gross payments exceeding IRS thresholds via Form 1099-K
- You will receive a 1099-K from Stripe (not D1 Arena) if you meet the reporting threshold
- You are responsible for reporting income and paying applicable taxes
International Payouts
- Non-U.S. Persons: Stripe collects W-8BEN and required foreign tax information
- Stripe handles withholding requirements as mandated by IRS regulations
6. Wallet Records & PIN Security
D1 does not offer a general consumer wallet deposit or add-funds product. The wallet interface records eligible earnings, tournament refunds or prizes, adjustments, and payout activity.
Wallet PIN
- A six-digit PIN may be required for protected wallet or payment actions.
- PINs are stored using one-way hashing and must not be shared.
- Rate limits, lockouts, two-factor authentication, identity checks, or re-verification may apply.
A general manual withdrawal flow is not available to every account. Eligible creator and tournament payouts use the active Stripe and D1 approval workflows described below.
7. Competition Structure and Legal Availability
D1 structures tournaments around recorded participant or team performance and publishes applicable rules, brackets, fees, and prizes. Texas Penal Code Chapter 47 excludes certain prize offers to actual contestants in bona fide contests for the determination of skill, speed, strength, or endurance from its definition of a bet. That statutory text does not make every game or event lawful everywhere, and these Terms are not a legal opinion about any specific contest.
- You must follow the game rules, tournament rules, eligibility controls, and applicable law.
- You may not manipulate results, collude, use unauthorized cheats, enter from a blocked location, falsify age or identity, or evade account restrictions.
- D1 may cancel, restrict, refund, hold, investigate, or require additional review of an event or transaction.
8. User Conduct
Prohibited behaviors:
- Harassment, threats, or defamation
- Obscene, offensive, or illegal content
- Unauthorized automated access
- Impersonation or identity fraud
- Cheating or fraudulent activities (results in permanent ban)
- Sharing accounts or security credentials
- Attempting to bypass 2FA or security measures
- Submitting fraudulent identity documents
9. Tournament Rules
- All participants must follow D1 Arena tournament rules
- Violations result in disqualification
- D1 Arena decisions on disputes are final
- Cheating detection may result in prize forfeiture and permanent ban
- Identity verification may be required before prize distribution
10. Membership Tiers & Fee Structure
Current membership features and economics are:
- Starter (Free): Eligible creator product share 75% before processing; tournament total fee 11.4%; RTMP up to 720p; VOD retention 10 days.
- PRO ($14.99/month): Eligible creator product share 82% before processing; tournament total fee 9.4%; RTMP or SRT up to 720p; VOD retention 30 days.
- Ultimate ($29.99/month): Eligible creator product share 90% before processing; tournament total fee 8.4%; RTMP, SRT, or WHIP up to 1080p; VOD retention 60 days; ad-free viewing.
- Partner (invite-only): Eligible creator product share 95% before processing; tournament total fee 7.4%; RTMP, SRT, or WHIP up to 2160p; VOD retention 90 days; ad-free viewing.
For creator tips and supporter subscriptions, the product share before processing is 75% on Starter, 82% on PRO, 90% on Ultimate and 95% on Partner. Processing components are separate, so these percentages are not final creator deposits. Review the transaction’s fee breakdown for the amount allocated to the creator. These shares do not include platform advertising revenue. Displayed checkout terms control. Memberships renew until cancelled as described at checkout, and changes apply prospectively as permitted by law.
Geographic Restrictions
Paid-entry tournament participation is currently blocked for accounts located in Arizona, Arkansas, Connecticut, Delaware, Louisiana, Maryland, Montana, South Carolina, South Dakota, and Tennessee. This is a platform safeguard, not a representation that paid competition is lawful everywhere else. D1 may change restrictions based on law, event facts, or provider requirements.
Payouts
Stripe Connect handles eligible connected-account payouts. Identity, tax, bank, reserve, chargeback, location, age, and account requirements may apply. A general manual withdrawal button and a universal $100 withdrawal rule are not part of the current product. Tournament prizes follow the tournament hold and administrator-approval workflow; the legacy bi-monthly tournament auto-payout command is disabled and unscheduled. Stripe may separately apply a connected account's provider-managed bank payout schedule.
11. Tips (Voluntary Support)
Tips are voluntary payments to support eligible creators or teams and are not wagers, deposits, purchases of D1 Cred, or payments for a guaranteed outcome.
- Tips use Stripe checkout and connected-account routing. The displayed amount, processing calculation, creator share, and recipient information must be reviewed before confirmation.
- For creator tips and supporter subscriptions, the product share before processing is 75% on Starter, 82% on PRO, 90% on Ultimate and 95% on Partner. Processing components are separate, so these percentages are not final creator deposits. Review the transaction’s fee breakdown for the amount allocated to the creator.
- Tips are generally final once processed, subject to applicable law, payment error, fraud review, chargeback handling, and the Refund Policy.
- You may not use tips for money transmission, self-funding abuse, fee evasion, fraud, harassment, or prohibited goods or services.
- Youth creators may receive eligible tip or supporter-subscription earnings only through the separate verified parent/guardian monetization-consent and Stripe setup path. Paid-entry tournaments and cash tournament prizes remain unavailable to youth accounts.
12. Merchandise Store
Verified sellers may list and sell merchandise through the D1 Arena Merch Store. All transactions use Stripe Connect destination charges.
Merch Fee Structure (by Tier)
- Starter: 8% platform fee + 5.4% processing fee + $0.30 = 13.4% + $0.30 total per sale
- PRO: 6% platform fee + 5.4% processing fee + $0.30 = 11.4% + $0.30 total per sale
- Ultimate: 4% platform fee + 5.4% processing fee + $0.30 = 9.4% + $0.30 total per sale
Seller Requirements
- Completed Stripe Connect onboarding and identity verification
- Physical products: Seller is responsible for shipping, tracking, and delivery
- Digital products: Files are delivered automatically after purchase
- Sellers must comply with all applicable consumer protection laws
Buyer Protections
- 14-day refund window for eligible orders
- Refund requests are reviewed by the seller
- D1 Arena may intervene in disputes at its discretion
13. Sales Tax & VAT
D1 Arena collects applicable sales tax, VAT, and GST as required by law. Tax is calculated automatically at checkout based on the buyer's location using Stripe Tax.
How Tax is Applied
- United States: State and local sales tax is collected where required. Tax rates vary by jurisdiction.
- European Union: VAT is collected based on the buyer's country of residence.
- United Kingdom: UK VAT is applied at the standard rate.
- Canada: GST/HST is collected based on the buyer's province.
- Australia: GST is applied at the standard rate.
- Japan: Consumption tax (JCT) is applied at the standard rate.
- New Zealand: GST is applied at the standard rate.

Tax amounts are shown on the Stripe Checkout page before you confirm payment. Receipts with full tax breakdowns are emailed after purchase. D1 Arena Inc. is a US C Corporation registered in Texas.
14. Supporter Subscriptions
D1 Arena allows viewers to subscribe to their favorite streamers on a monthly recurring basis. Subscriptions provide ongoing support to creators and unlock exclusive benefits.
Subscription Tiers
- Tier 1 (Supporter): $4.99/month - Basic supporter badge, chat priority
- Tier 2 (Supporter+): $9.99/month - Enhanced badge, exclusive emotes
- Tier 3 (VIP Supporter): $24.99/month - VIP badge, all tier perks, priority support
Billing & Cancellation
- Billing Frequency: Monthly recurring charge on the same date each month
- Payment Methods: Credit/debit card via Stripe
- Cancellation: Cancel anytime from your account settings. Access continues until the end of your billing period
- Refunds: Platform subscription fees are non-refundable once charged. You retain access until your subscription period ends. See our Refund Policy for full details.
Revenue Split
Subscription revenue is shared between the streamer and the platform based on the streamer's membership tier:
- Starter Members: Streamer product share is 75% before processing (25% platform fee)
- PRO Members: Streamer product share is 82% before processing (18% platform fee)
- Ultimate Members: Streamer product share is 90% before processing (10% platform fee)
Transaction Fees
Recurring supporter subscriptions deduct the applicable D1 product-fee percentage and the separate 5.4% processing reserve before the creator’s destination amount. D1 absorbs the fixed $0.30 processing component on the initial invoice and each renewal; that fixed component is not deducted from the creator’s subscription proceeds.
15. Intellectual Property & User-Generated Content
All Platform content, including the D1 Arena name, logos, software, and design elements, is the property of D1 Arena or its licensors and is protected by copyright, trademark, and other intellectual property laws. Reproduction, distribution, or modification without prior written permission is prohibited.
User-Generated Content (UGC) License
By submitting content to D1 Arena (including but not limited to stream content, VODs, clips, chat messages, team descriptions, profile content, emotes, Studio Assets, GIFs, stickers, overlays, channel panels, supporter badges, alert sounds, and forum posts), you grant D1 Arena a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, transcode, moderate, and create derivative works from your content in connection with the Platform, including live chat, messages, stream overlays, shared asset libraries, exported clips, and Platform promotion. You retain ownership of your original content. You may delete your content at any time, which will terminate this license except for copies already in circulation or required for legal/operational purposes. From time to time, D1 Arena may feature or redistribute your public Platform content (including streams, VODs, clips, thumbnails, and related promotional images) on D1 Arena's official social media accounts and other marketing channels. Doing so does not transfer ownership of your content, remove it from your channel or library on the Platform, or limit your rights to use your own content elsewhere. By uploading or creating such content on the Platform, you authorize these promotional uses under the license above.
DMCA & Copyright
D1 Arena respects intellectual property rights. If you believe your copyrighted work has been infringed, please see our DMCA Policy for details on filing a takedown notice. Our Content ID system may automatically detect copyrighted audio in streams and uploads.
16. Privacy & Data Security
The Privacy Policy explains the data D1 and its providers collect, the purposes, retention, disclosures, and available rights. No Internet service can guarantee absolute security. You must use available account-security controls and promptly report suspected compromise.
17. Disclaimers
Platform provided "as is" without warranties. We do not guarantee uninterrupted service.
18. Limitation of Liability
D1 Arena is not liable for indirect, incidental, special, consequential, or punitive damages from Platform use, including but not limited to losses from unauthorized account access where security recommendations (2FA, strong passwords) were not followed.
19. Account Termination
D1 Arena may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent identity verification attempts
- Tax compliance violations
- Suspicious financial activity
- Repeated security violations
20. Modifications
Terms may be updated. Continued use constitutes acceptance of new Terms. Material changes affecting identity verification, tax compliance, or security requirements will be communicated via email.
21. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for any disputes arising from these Terms or your use of the Platform.
22. Live Streaming, Chat, and Native Communications
You may stream or share only content you have the right to use. Public streams, VODs, clips, chat, profiles, and tournament records may be moderated, analyzed, retained, or removed under these Terms and the Community Guidelines.
Stream Chat and Community Tools
- Channel owners and authorized moderators may use bans, timeouts, slow mode, follower/subscriber controls, polls, predictions, rewards, and supported commands.
- D1 Cred has no cash value and may not be sold, transferred, or converted to money.
- Ordinary stream-chat messages are subject to the current 30-day cleanup process; moderation, dispute, security, legal-hold, and related records may follow different periods.
Watch Parties
Watch Parties synchronize D1-hosted VOD playback with party chat. The host may turn D1-native voice off, limit it to friends, or allow signed-in participants. Camera and screen sharing may be available when voice access is enabled.
Friend Calls and Team HQ
Supported messaging surfaces provide friends-only voice/video calls with blocking and age-band controls. Team HQ provides authenticated text, voice, camera, and screen sharing for authorized team members. These communication rules also apply to supported multi-person friend conversations and calls, in addition to direct messages, Team HQ and Watch Parties.
Real-Time Media and Consent
Real-time media uses WebRTC with DTLS-SRTP, peer-to-peer routing when possible, and coturn relay fallback. D1 processes authentication, signaling, roster, safety, and activity metadata needed to operate these features. The current implementation does not record or store call media. You may not record, capture, monitor, or redistribute another person's voice, video, or screen without authorization and every consent required by law. Do not expose passwords, payment information, private communications, personal data, or illegal content through camera or screen sharing.
23. Dispute Resolution & Arbitration
You and D1 Arena agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation by contacting our Support Center. If unresolved within 30 days, either party may initiate binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Texas and be conducted in English.
Class Action Waiver
YOU AND D1 ARENA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this specific provision is found to be unenforceable, the entirety of this arbitration section shall be null and void.
Exceptions to Arbitration
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
24. Indemnification
You agree to indemnify, defend, and hold harmless D1 Arena, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; (d) any content you submit to the Platform; or (e) your participation in tournaments.
25. Force Majeure
D1 Arena shall not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to natural disasters, wars, terrorism, riots, government actions, internet or power outages, DDoS attacks, or third-party service provider failures (including Stripe, AWS, Cloudflare, and other infrastructure providers).
26. Export Controls & Sanctions
You agree not to access or use the Platform from any country, territory, or jurisdiction subject to comprehensive U.S. sanctions (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions). You represent that you are not on any U.S. government restricted parties list.
27. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
28. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Community Guidelines, DMCA Policy, and Refund Policy, constitute the entire agreement between you and D1 Arena regarding your use of the Platform and supersede all prior agreements and understandings.
29. Artificial Intelligence (AI) Features
D1 uses xAI/Grok for moderation assistance, support, game detection, diagnostics, analysis, and optional content generation. Relevant user content, screenshots, prompts, chat context, and system instructions may be sent to xAI and processed under xAI's applicable terms.
- Standard xAI API requests and responses may be retained by xAI for up to 30 days for abuse monitoring unless zero-data-retention treatment is enabled for the applicable D1 xAI team.
- xAI states that API inputs and outputs are not used to train its models without permission.
- D1 may store prompts, outputs, corrections, moderation results, ratings, and support history to provide, secure, audit, or improve D1 features.
- AI output can be incomplete, inaccurate, or inappropriate and must not be treated as legal, medical, financial, safety, or other professional advice.
- Automated controls may hold, remove, restrict, or flag content. Available enforcement actions may be appealed through D1 support.
30. Self-Serve Advertising
D1 Arena offers a self-serve advertising platform for businesses and individuals:
- Advertiser Obligations: Advertisers are responsible for ensuring their ads comply with all applicable laws, D1 Arena's advertising policies, and community guidelines
- Creative Standards: All ad creatives undergo AI and human review before serving. Creatives that violate our policies will be rejected.
- Billing: Advertising spend is billed through Stripe. Advertisers are responsible for maintaining valid payment methods.
- Ad Spend: Impressions served are non-refundable. Unspent campaign budgets may be refunded upon request.
- Fraud: Click fraud, impression manipulation, or other deceptive practices will result in immediate account termination and forfeiture of any remaining budget.
- No Third-Party Networks: D1 Arena operates an in-house ad system. We do not use third-party ad networks.
31. D1 Frenzy (Stream Hype Bar)
- D1 Frenzy is the live stream hype meter that fills as viewers contribute tips and subscriptions during a stream.
- Frenzy displays a 5-level progress bar with contributor count and a countdown timer; reaching higher levels triggers visual celebrations on the stream.
- Contributions to a Frenzy session are processed as ordinary tips or subscriptions and follow the standard fee splits and refund rules described elsewhere in these Terms.
- The Frenzy mechanic itself does not change tip or subscription pricing, eligibility, or refund rights.
- Manipulation of Frenzy levels through self-funding, coordinated artificial contributions, or other deceptive practices is prohibited.
32. Gift Subscriptions
- Users may purchase a Supporter Subscription on behalf of another specific D1 Arena user. The recipient must be selected at purchase time; gift subscriptions are not distributed randomly.
- Gift subscriptions follow the same tier pricing as regular Supporter Subscriptions ($4.99 / $9.99 / $24.99 for Tier 1 / Tier 2 / Tier 3).
- The streamer revenue split for gift subscriptions matches the streamer's membership tier.
- Gift subscriptions are non-refundable once delivered to the recipient. If the recipient is no longer eligible at the time of processing, contact our Support Center for review.
- Abuse of gift subscriptions (self-gifting via alternate accounts, coordinated gifting for manipulation, fraudulent recipient information) is prohibited.
33. Content ID & Copyright Protection
- D1 Arena uses an in-house Content ID system (AcoustID) to automatically detect copyrighted audio in streams and uploads
- Content Strikes: Strike 1 = warning, Strike 2 = temporary streaming restriction, Strike 3 = extended restriction and manual review
- Users may dispute Content ID matches through the appeal process if they believe the detection was in error or they hold appropriate licenses
- Repeated violations may result in permanent account suspension

34. Streaming Protocol Access
- Starter: RTMP up to 720p.
- PRO: RTMP or SRT up to 720p.
- Ultimate: RTMP, SRT, or WHIP up to 1080p.
- Partner: RTMP, SRT, or WHIP up to 2160p.
Protocol and resolution access is enforced by tier. For WHIP streams, compatible viewers attempt WHEP playback first and fall back to HLS when necessary. D1 does not guarantee a particular latency, uninterrupted playback, or protocol availability on every device or network.
35. Account Lifecycle
- Deactivation: You may temporarily deactivate your account. The current reactivation window is 30 days and uses verification controls.
- Deletion request: A grace period allows cancellation before permanent processing.
- After deletion: D1 removes or de-identifies personal data according to the Privacy Policy, subject to fraud, chargeback, tournament, dispute, security, legal-hold, tax, accounting, and other legal obligations. Provider-held records remain governed by the provider.
- Content and records: User content may be removed, while tournament results, transaction records, enforcement evidence, or other records may be retained or de-identified where needed.
36. Phone Verification & SMS 2FA
- Phone verification is provided through Twilio's Verify service
- SMS-based two-factor authentication is available as an additional security option
- Standard carrier messaging rates may apply for SMS verification codes
- D1 Arena is not responsible for SMS delivery failures caused by carrier issues
- Phone numbers are stored securely and used only for verification and security purposes
37. D1 Cred (Channel Points)
- D1 Cred is a virtual engagement currency earned by watching streams and participating in community activities
- D1 Cred has no monetary value and cannot be exchanged for cash, gifted, transferred, or sold
- D1 Arena reserves the right to adjust, reset, or remove D1 Cred balances at its discretion
- Abuse of the D1 Cred system (botting, farming, exploiting bugs) will result in balance removal and potential account suspension
- When predictions are cancelled or voided, wagered D1 Cred is returned to participants

By participating, you agree to the event rules, eligibility controls, identity and payment requirements, and applicable law. D1 does not guarantee that a particular event or feature is legally available in every location.
Platform social promotion
By creating public clips on D1 Arena, you acknowledge that eligible clips (and Clip of the Week winners) may be redistributed on D1-operated social channels via our social posting provider (Zernio), as described in the Privacy Policy. Partnership/Founding Member eligibility and shareability rules apply. Go-live social posts are separately gated.
Age policy: D1 Arena requires users to be at least 13. Accounts for ages 13–17 require parent/guardian verification under D1 policy. COPPA generally concerns personal information collected online from children under 13; D1’s teen controls are additional platform safeguards.
